Social security disability marketing is the work of reaching SSDI and SSI claimants, turning them into consultations, and signing cases whose fees are capped by SSA and paid only after a favorable decision.

That fee structure makes disability lawyer marketing its own discipline, inside the wider system described in law firm marketing.

The SSA fee cap sets your marketing math

Under SSA's fee-agreement process, a representative's fee may not exceed the lesser of 25% of past-due benefits or $9,200, for favorable decisions on or after November 30, 2024, a ceiling SSA set in a Federal Register notice dated May 10, 2024 (89 FR 40523).

SSA can raise that cap again, so treat $9,200 as the figure in force as of October 2026 and re-check before you build a year of spending on it.

Illustrative framing of SSA's fee-agreement rule; SSA can change the cap.

Once SSA approves the fee agreement, the fee written in it is the maximum you may charge and collect for all services on the claim, and it comes out of the claimant's past-due benefits after a favorable decision.

If the claim goes past the level a fee agreement covers, such as to the Appeals Council, SSA requires the fee petition process instead.

The constraint is blunt: revenue per case tops out at $9,200 under the fee-agreement process and arrives only after a favorable decision, so a cost per signed case that looks routine in personal injury can erase the margin.

Firms that also take VA cases work under different numbers: under 38 CFR 14.636, fees up to 20% of past-due benefits are presumed reasonable and fees above 33 1/3% are presumed unreasonable, and both presumptions can be rebutted; that practice is covered in veterans disability lawyer marketing.

How deep the demand pool runs

SSA's Monthly Statistical Snapshot counted about 6.98 million disabled workers receiving Social Security Disability Insurance benefits in August 2026, averaging $1,635.90 a month, within 7.955 million total DI beneficiaries including dependents.

That counts people already on the rolls, not the applicants behind them, and it publishes no approval or denial rate, so treat claimant-supply figures in a sales deck as unverified.

Competition is broad as well: the ABA counted about 1.37 million licensed lawyers in the US in 2025, up 1.38% from 2024, and no channel is cheap, so profit goes to the firms that waste the least after the click.

Where SSDI leads come from

Bar referral services

Bar-run referral services are a structured source: Florida Bar Lawyer Referral Service panel members give a 30-minute consultation for no more than $25, carry at least $100,000 of malpractice insurance, and remit 12% of attorney's fees on regular-panel cases, with bankruptcy and Social Security exempt from that 12%.

That is Florida's statewide service; local bar referral services set their own terms, and the Florida Bar does not refer in areas a local service already covers.

Bought SSDI leads

The ABA Model Rules take paid leads up in the comments to Rule 7.2: paying a lead generator fits them only where the generator does not recommend the lawyer, the payment stays consistent with the fee-sharing rules, and the generator's own communications satisfy Rule 7.1.

The comments also bar paying a generator that implies it analyzed a person's legal problem to pick the right attorney, and whether per-lead or per-case pricing counts as fee sharing is a state-by-state question.

Pricing models, shared versus exclusive versus pay-per-call, are compared in legal leads.

Search and content

Disability claimants research symptoms, work history and program rules before contacting anyone, so the durable assets are practice-area pages, city pages and a Google Business Profile that answer those questions.

Converting SSDI inquiries into signed cases

Unbounce's 2024 Conversion Benchmark Report puts the median conversion rate for family and disability law landing pages at 6.3%, with top performers at 13.1% or better, against a 6.6% median across all industries.

Those are single landing pages built on Unbounce counting form conversions only, so most phone calls are missing, and they are one vendor's dataset, not a whole-website benchmark.

Unbounce also reports legal pages converting better on mobile than desktop, and paid search converting nearly 2x better than any other source in legal.

Illustrative: one month of a disability intake funnel

Illustrative numbers, not a benchmark; no published consultation or signed-case rate exists for disability firms.

The numbers that decide profitability are yours: cost per consultation request, held rate, and signed-case rate.

What happens after the form is where capped-fee practices bleed, and legal intake covers the follow-up, screening and scheduling work that turns a request into a held consultation.

This is the work CRO does on a disability site: one controlled test a month on click-to-call placement, consult forms, scheduling and trust signals, judged by consultations booked and cases signed, with read access to intake numbers; it never staffs or trains intake.

At a 6.3% median, a typical page loses more inquiries than a top performer would, and a capped fee leaves no budget to outspend a leak.

The advertising rule that shapes SSDI campaigns

ABA Model Rule 7.1 prohibits any false or misleading communication about a lawyer or the lawyer's services, including statements that omit a fact needed to keep them from being materially misleading.

The ABA's 2018 amendments left that text unchanged and moved the old subparts, such as unjustified expectations and comparisons, into the Comments, where Comment [1] says the rule governs all communications about a lawyer's services, including advertising.

Model Rules bind no one until a state adopts them, and some states keep the older subparts in their black letter, so your state's version of Rule 7.1 is the one that controls.

For a disability practice that means no implied promises about outcomes, and any past-results or testimonial copy checked against your state's rules before it runs.

Confirm anything you plan to publish with your state bar's ethics counsel or an ethics lawyer.

What to do first

Price acquisition against the $9,200 ceiling and the decision timeline, not against personal injury economics.

Fix the funnel before buying more traffic, because capped fees give you no room to outspend a leak.

Then back the channel with the lowest cost per signed case, measured on consultations booked and cases signed, not lead counts.

CRO and local SEO run $2,500 a month each, $5,000 together, with 6-month minimums, and the free audit arrives as a prioritized plan within 3 business days, no call required.

Frequently asked questions

How much can a representative charge in a Social Security disability case?

Under SSA's fee-agreement process, the fee may not exceed the lesser of 25% of past-due benefits or $9,200 for favorable decisions on or after November 30, 2024. Higher fees require the separate fee petition process, and SSA can raise the cap again.

When does a disability firm actually get paid?

After a favorable decision: once SSA approves the fee agreement, the fee written in it is the maximum you may charge and collect for all services on the claim, and it comes out of the claimant's past-due benefits. Claims that go past the agreement's level, such as to the Appeals Council, move to the fee petition process.

What is a good conversion rate for a disability law landing page?

Unbounce's 2024 Conversion Benchmark Report puts family and disability law landing pages at a 6.3% median, with top performers at 13.1% or better. Those are single pages on one builder counting form fills only, so treat them as a reference point for a page, not a target for your whole site.

Are SSDI leads worth buying?

Only if the cost per signed case still clears a margin under the fee cap and the payment timeline. Per-lead pricing looks cheap per inquiry and expensive per case, so track requests through held consultations to signed cases before scaling any paid source.

Can a disability law firm advertise online?

Firms advertise in every consumer practice area, but ABA Model Rule 7.1 prohibits false or misleading communications about a lawyer or the lawyer's services, including material omissions, and your state's adopted version controls. Confirm specific campaigns with your state bar's ethics counsel or an ethics lawyer.
