Business development for lawyers is the deliberate work of building a personal book of business: the referral relationships, professional network and reputation that bring matters to you, run alongside the firm's marketing.
It is the personal half of a pipeline whose other half belongs to the firm: the search rankings, ads and website that turn demand into consultations, covered in law firm marketing.
The two halves feed each other: in Clio's 2025 survey of 1,000 US adults, most people who had recently hired a lawyer used a referral, and more than half said they would also use the internet for their next lawyer.
What lawyer business development is, and is not
Business development is personal and deliberate: you decide which matters you want more of, then build relationships with the people able to send them.
Marketing is the firm's engine, and it captures demand whether or not any individual partner is in the room.
Firms lean on the relationship half too: Clio's 2025 report on firms (1,702 legal professionals) says the vast majority of firms have a website and rely on referrals, and nearly two-thirds focus on online reviews.
Past clients are not a given either: in the same Clio consumer survey, 24% said they would be unlikely to rehire the lawyer they last worked with.
An attorney business development plan
A plan that survives a full caseload fits on one page, and five steps reviewed monthly beat a strategy day once a year.
Name the matters you want more of
A niche sharpens every later decision: which events to attend, which lawyers to court, what to write.
List the 20 people who can send them
Three pools hold almost every potential source, and Clio's 2019 survey sized them.
Set your rules before your first ask
Reciprocal referral agreements must be non-exclusive and disclosed to the client under ABA Model Rule 7.2(b)(4), and a fee split with a lawyer at another firm needs the client's agreement confirmed in writing under Rule 1.5(e).
Show up where your sources look
Bar sections, community and professional groups, LinkedIn, and the occasional talk or seminar keep you in the mental short list when a referral moment arrives.
Track consultations and signed cases by source
Relationships that never produce a consultation are friendships; the ones that produce cases get more of your time.
Clio's 2019 survey of 2,000 US consumers sized the three pools lawyer-shoppers draw on: friends and family 32%, another lawyer 16%, and a non-legal professional 9%.
Friends and family, 32%
The biggest pool, fed by reputation in your community and by past clients who would hire you again.
Another lawyer, 16%
Lawyers in non-competing practice areas, the pool reciprocal referral agreements under Rule 7.2(b)(4) are built for.
A non-legal professional, 9%
CPAs, financial advisors, real estate agents and counselors, who see the problem long before it is a legal one.
The constraint is repetition, so the plan needs a standing monthly calendar slot.
What the rules say about paying for referrals
Referrals are where business development meets the advertising rules, so open the rulebook before the first ask.
ABA Model Rule 7.2(b) says a lawyer shall not give anything of value to a person for recommending the lawyer's services, and it names five exceptions.
Rule 7.2(b) excepts
- The reasonable cost of permitted advertising
- The usual charges of a legal service plan or a not-for-profit or qualified lawyer referral service
- Buying a law practice under Rule 1.17
- Reciprocal referral agreements that are not exclusive and are disclosed to the client
- Nominal thank-you gifts
Rule 7.2(b) bars
- Anything of value to a person for recommending your services, outside those exceptions
- Gifts promised or expected in advance for future referrals
- Exclusive referral arrangements
- Paying someone solely for the referral, outside a Rule 1.5(e) fee split
The gift exception, added in 2018, covers nominal thanks comparable to holiday tokens under Comment [4], but nothing held out as payment, and not every state has adopted it.
Splitting a fee with a referring lawyer at another firm is its own rule: Model Rule 1.5(e) requires the split to match work done or each lawyer's joint responsibility, the client's agreement confirmed in writing, and a reasonable total fee.
Model Rule 7.2(b)(2) and Comment [6] limit paying a referral service to the usual charges of a not-for-profit or qualified service, one approved by an appropriate regulatory authority, and the published terms are concrete: Florida Bar Lawyer Referral Service panel members give a 30-minute consultation for no more than $25, remit 12% of attorney's fees on regular-panel cases, and carry at least $100,000 of malpractice insurance, under the Bar's published rules for its statewide service.
Word of mouth itself is not solicitation: ABA Formal Opinion 501 (April 13, 2022) says referrals from satisfied clients and unaffiliated third parties are not solicitation, while its cautionary example is a paralegal handing firm cards to injured people during weekend paramedic work, solicitation the firm ratified.
The rules above are the ABA Model Rules and an ABA opinion, the Florida terms cover only that Bar's statewide service, and your state's version controls, so confirm the mechanics with your state bar's ethics counsel or an ethics lawyer.
For the operating system itself, the asks, the cadence and the first 90 days, see how to get referrals as a lawyer.
Networking and LinkedIn: visible before you are needed
Referrers send work to people they can vouch for, and vouching requires remembering you exist when the moment arrives.
Networking and a current profile are what keep you on the short list a source consults before mentioning your name to a prospective client.
LinkedIn is one place that check happens: 32% of US adults use the platform, per Pew Research Center's 2025 survey, so a source who hears about you may expect to find a current profile there.
The playbooks live in their own articles: lawyer networking for the in-person system, and LinkedIn marketing for law firms for the profile and posting routine.
Business development for associates
Associates work under the same rules with one difference: the book gets built inside someone else's practice, so the firm's conflicts, niche and brand set the lanes.
Start narrow, one practice area, keep a complete profile, and be referable: answer quickly, report back to every sending lawyer, and never let a referred client go cold.
Formal Opinion 501 marks a useful line for a junior lawyer: it says referrals from satisfied clients and unaffiliated third parties are not solicitation, which is the kind of referral flow worth building.
Then ask the partners you admire how their first clients arrived; the answers map the paths this firm rewards.
Run it like a channel: consultations and signed cases
Business development earns its hours the way marketing does, by producing consultations that become signed cases, and the only numbers that matter are your own.
Track four figures by source: referrals received, consultations held, cases signed, and revenue per signed case, reviewed monthly against the time each relationship costs.
No published benchmark says what a referral relationship should produce, so the honest comparison is month over month, not against an industry average.
One piece of the firm's marketing touches every referral: the referred person will look you up, and the website either confirms the referral or undoes it, which is the job of law firm website conversion.
Frequently asked questions
What is business development for a lawyer?
The deliberate work of building a personal book of business: referral relationships with other lawyers and professionals, a network, and visibility with the people who can send you matters, run alongside the firm's marketing rather than instead of it.
Is business development the same as marketing for a law firm?
No. Marketing is the firm's demand-capture engine: search, ads and the website. Business development is the personal pipeline, and Clio's 2025 report on firms found the vast majority of firms rely on referrals even with a website in place.
How do associates start building a book of business?
Pick one practice area to be known for, keep a complete professional profile, and be easy to refer to: respond fast, report back to every sending lawyer, and ask the partners you admire how their first clients found them.
What should a lawyer measure to know business development is working?
Referrals received, consultations held and cases signed, by source, reviewed monthly. No published benchmark says what a referral relationship should produce, so judge the trend against your own last quarter, not an industry average.
Do the ethics rules reach lawyer business development?
The advertising and solicitation rules do. ABA Model Rule 7.2(b) bars giving anything of value for recommendations outside five exceptions, and Model Rule 1.5(e) governs fee splits between lawyers at different firms. State versions differ, so confirm your plan with your state bar's ethics counsel or an ethics lawyer.
